I. GENERAL FRAMEWORK
Introduction
The VOYA Boutique Hotel booking platform, which is accessible from the voya-havana.com website (the “Website”) is operated by the entity APVD B.V., (hereinafter “APVD”, “VOYA Boutique Hotel” or “Portal”), which gives users information on the hotel stay and room availability of VOYA Boutique Hotel Havana, with booking possible through the Website itself or by contacting VOYA Boutique Hotel Havana directly.
The terms “User” and “Guest” will be used in these General Terms and Conditions to refer to the natural or legal persons who access the Website for any reason.
Access and use of the Website, as well as engagement, use and enjoyment of the products and services it offers, including Pre-Booking and Online bookings (hereinafter the “Services”, for each one individually or together), entail the full and unconditional acceptance by the User of the General Terms and Conditions, as well as latest version of the “Legal Notice” and the “Privacy Policy”, available on the Website. APVD reserves the right to change, modify, add or remove parts of these General Terms and Conditions at any time; thus, it is recommended that you read these General Terms and Conditions before completing the booking and every time you access the Website.
For the User to book and enjoy the Services of the stays at VOYA Boutique Hotel Havana using the Website, he/she is directly engaging the following commercial entity: APVD B.V., with address at Keizersgracht 241, 1016EA Amsterdam, registered in Chamber of Commerce (KVK) of the Netherlands with number 59461306.
Use and engagement of Services through voya-havana.com
Pre-Booking Services APVD provides Users of the Website with all information related to the services and products offered therein, along with details regarding rates and rooms available in the hotels and/or destinations that interest the User. You can find all of the information related to the access and use of the different content and services included or accessible through the Website on the latest version of the “Legal Notice” available at voya-havana.com.
Booking Services
Booking hotel nights at voya-havana.com entails the User’s full and unconditional adherence to and acceptance of each and every one of the terms and conditions listed herein.
All stays may only be enjoyed by the booking’s titleholder and his/her companions.
VOYA Boutique Hotel reserves the right to prohibit changes to the titleholder for both single and group bookings, and to cancel bookings for which the titleholder has been changed without the prior and express approval of VOYA Boutique Hotel.
For multiple bookings (between two and ten rooms), VOYA reserves the right to submit the booking to special payment conditions, the prior identification of guests and to cancellation.
Change and Cancellations of Bookings The booked stay cannot be changed or canceled. If the User needs to make a change or cancel the booking, the penalty will be 100% of the full amount of the stay, unless otherwise stated in the rate’s terms and conditions. If the guest does not show up to VOYA Boutique Hotel Havana for his/her stay on the booked days, a penalty of 100% of the full amount of the stay will be applied.
By accepting the following clauses, the User states and accepts:
That he/she is of legal age and has full capacity to make the booking, and hereby states that he/she understands and comprehends all of the terms and conditions on the Website.
That the data provided when he/she makes the booking online are accurate, comprehensive and concise.
That accessing this web page is the responsibility of the User.
From the moment the User makes his/her request, his/her booking is subject to these terms and conditions of engagement and, as a result, the above-stated cancellation/no-show policy.
VOYA Boutique Hotel will confirm the booking request made by the User by email within a period of 24 hours from when the request was correctly received. If that email is not received, the booking request will be deemed to not have been formalised.
For the above purposes, the User expressly agrees to allow VOYA Boutique Hotel to run a pre-authorization on the payment card, in order to verify the availability of funds and its source data.
Once the booking is made, the electronic document with the formalised booking will be archived and the User may access it at any time.
The User confirms the requested booking, i.e., the dates stated, the number of rooms, number of guests and the chosen Hotel.
The terms and conditions and price of booking, which are expressly determined in the terms and conditions of the rate, are expressly included at the time the booking is made.
That the User or the person making use of the booking must be the cardholder of the credit card used for payment. The titleholder of the credit/debit card used for the booking must be the same as the guest staying at the hotel. The credit/debit card used for the booking may be requested upon arrival to verify that the provided data are correct. The titleholder of the card must be present at that time.
With respect to the relationship with APVD B.V., it gives the user the ability to book rooms at VOYA Boutique Hotel Havana through its website, but does not offer any type of hotel service under its responsibility.
Depending on the selected rate, payment will be made when the booking is confirmed or at the hotel. In the second case, in the event of cancellations or no-shows, the booking will be canceled and 100% of the total amount of stay will be charged, unless otherwise stated in the rate terms and conditions, which could be flexible.
Offers will only be valid during the time they are accessible for the recipients of the service.
VOYA Boutique Hotel reserves the right to modify bookings that could be affected by system errors, by third parties or other unexpected circumstances. If that situation exists, the User will be informed in writing of the actual valid price and/or possible alternatives. In the case the new conditions are not accepted, the User has the right to cancel the booking without any extra charge. If no response is received by the User in the following 48 hours from the modification of the booking, VOYA Boutique Hotel shall cancel the booking without any charge to the User.
VOYA Boutique Hotel reserves the right to unilaterally cancel the booking when there is an incident detected with the credit card used for payment, such as lack of approval, different cardholder and User and/or the accommodated guests, or any breach of the conditions or statements mentioned herein.
Modification of these General Terms and Conditions
APVD may, at any time and without prior notice, modify these General Terms and Conditions. These modifications may be published at voya-havana.com in order for the User to consult the most updated version before engaging the Services. The Pre-Booking services and the engagement of any products and/or services available on the website, once the General Terms and Conditions have been modified, shall entail such User’s acceptance of the modified General Terms and Conditions.
Applicable law and jurisdiction
These General Terms and Conditions are governed by Dutch law. APVD and the User, expressly waiving any other jurisdiction, are subject to the Courts and Tribunals of the User’s registered address for any dispute that may arise from the use of the Website or the Services.
In the event that the User is domiciled outside the Netherlands, APVD and the user submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of the Netherlands.
